Get On The Lawn – Terms of Service

1. Introduction

Welcome to Get On The Lawn (“we,” “our,” “us”). By accessing or using our website at https://www.getonthelawn.ca/ (the “Site”) or engaging our lawn care and landscaping services (collectively, the “Services”), you agree to these Terms of Service (“Terms”). Please read them carefully. If you do not agree, you may not use the Site or engage our Services.

2. Definitions

Client: Any individual or entity that requests or receives Services from Get On The Lawn.
Services: All lawn care, landscaping, snow & ice management, and related offerings provided by Get On The Lawn.
Agreement: The binding contract formed when a Client accepts a Service quote or books Services, incorporating these Terms.
Quote: A written or emailed estimate of cost, scope, and schedule provided by Get On The Lawn.
Site Content: Text, images, video, logos, or other materials on https://www.getonthelawn.ca/.

3. Scope of Services

3.1 We provide professional, eco-friendly Services including but not limited to precision mowing, fertilization, aeration, overseeding, seasonal clean-ups, sod installation, garden design, irrigation start-up & winterization, snow plowing, ice control, pressure washing, hardscape installation, and landscape lighting.

3.2 The precise Services to be performed shall be as described in the Quote accepted by the Client. Any modifications or additions will require a written Change Order and may incur additional fees.

4. Client Obligations

4.1 Access & Preparation

Client shall ensure safe, unobstructed access to the property and work areas.
Prior to Services, Client must remove breakable items and notify us of underground utilities, irrigation lines, or potential hazards.

4.2 Payment

Unless otherwise specified, payment in full is due within 15 days of invoice.
Late payments incur interest at 1.5% per month (18% annual) and may result in service suspension.
Returned checks incur a $50 fee.

4.3 Cancellations & Rescheduling

For routine maintenance, Client must provide at least 24 hours’ notice to reschedule without penalty.
For one-time projects or snow & ice calls, Client must provide at least 48 hours’ notice; otherwise, a 25% cancellation fee applies.
In emergency winter conditions, we reserve the right to prioritize urgent calls over reschedules.

5. Quotes & Pricing

5.1 All Quotes are valid for 30 days from issuance.
5.2 Quotes are based on current market rates for labor, materials, and equipment. We reserve the right to adjust pricing for significant cost increases (e.g., fuel, fertilizer) with 10 days’ notice.
5.3 Taxes (e.g., HST) are not included in quoted prices and will be added to invoices as required by law.

6. Warranty & Disclaimers

6.1 Service Warranty

We warrant that Services will be performed in a professional, workmanlike manner consistent with industry standards.
For lawn care treatments, we offer a 30-day satisfaction guarantee: if issues (e.g., spotty growth) arise directly from our work, we will re-treat affected areas at no charge.

6.2 Disclaimers

We do not warrant specific growth outcomes or guarantee against acts of nature (drought, pest outbreaks beyond standard treatments, extreme weather).
Equipment use may cause minor aesthetic impacts (e.g., tire tracks) which typically resolve after one mow cycle.
Client acknowledges that all living landscapes are dynamic and results vary.

7. Liability & Indemnification

7.1 Limitation of Liability

To the fullest extent permitted by law, Get On The Lawn’s total liability for any claim related to Services or the Site shall not exceed the total fees paid by the Client in the preceding 12 months.
Under no circumstances shall we be liable for consequential, incidental, or punitive damages (lost profits, loss of use, etc.).

7.2 Indemnification

Client agrees to indemnify and hold harmless Get On The Lawn, its officers, employees, and agents, from any third-party claims arising from Client’s negligence, failure to disclose hazards, or breach of these Terms.

8. Intellectual Property

8.1 All Site Content, designs, logos, text, and graphics are our property or licensed to us and protected by copyright and trademark laws.
8.2 Client may download or print Site Content for personal, non-commercial use only. No other use, reproduction, modification, or distribution is permitted without our express written consent.

9. Privacy

Your use of the Site and Services is governed by our Privacy Policy (https://www.getonthelawn.ca/privacy). By accepting these Terms, you also agree to our collection and use of personal information as outlined therein.

10. Governing Law & Dispute Resolution

10.1 These Terms and any Agreement shall be governed by the laws of Ontario and Canada.
10.2 Any dispute arising shall first be addressed through good-faith negotiation. If unresolved, either party may pursue mediation. If mediation fails, disputes will be finally resolved by binding arbitration in Hamilton, Ontario, under the Arbitration Act (Ontario).

11. Termination

11.1 We may suspend or terminate Services or access to the Site if Client breaches these Terms or fails to pay when due.
11.2 Upon termination, Client remains responsible for all fees and accrued charges up to the termination date.

12. Changes to Terms

We may update these Terms at any time by posting a revised version on the Site. The “Last updated” date will reflect the change. Continued use of the Site or Services after updates constitutes acceptance of the new Terms.
